These Terms of Service ("Terms") govern your use of IrisMapper Pro ("Service", "Platform", "Software") provided by IrisLab ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, subscribing to a plan, or using any part of IrisMapper Pro, you accept these Terms in full. If you do not agree to these Terms, you must not use the Service.
2. Description of Service
IrisMapper Pro is a web-based iris mapping software platform designed for healthcare practitioners including:
- Certified iridologists
- Naturopathic doctors
- Holistic health practitioners
- Other licensed healthcare professionals using iris analysis
The Service provides tools for uploading iris photographs, overlaying professional iris maps, adjusting images, and generating documentation for clinical use.
3. User Accounts and Eligibility
3.1 Account Creation
To use IrisMapper Pro, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
3.2 Professional Use
IrisMapper Pro is intended for professional healthcare use only. You represent that you are a qualified healthcare practitioner or are using the Service under the supervision of one.
3.3 Account Responsibility
You are responsible for all activity that occurs under your account. You agree to:
- Keep your password secure and confidential
- Not share your account with others (except authorized team members on Clinic plans)
- Comply with all applicable laws and regulations
4. Subscription Plans and Billing
4.1 Free Trial
New users receive a 14-day free trial of paid features. A payment card is required to start the trial. You will not be charged until the trial period ends unless you cancel before the trial expires.
4.2 Subscription Plans
We offer the following subscription plans:
- Free Plan: Limited features, no payment required
- Practitioner Plan: £10/month, £100/year, or £170/2 years
- Clinic Plan: £30/month, £300/year, or £450/2 years (up to 5 team members)
4.3 Billing
- Subscriptions are billed in advance on a recurring basis (monthly, yearly, or 2-year intervals)
- Payments are processed securely through Stripe
- Prices are in British Pounds (GBP) and exclude applicable taxes
- Payment failures may result in service suspension
4.4 Cancellation
You may cancel your subscription at any time:
- Access your Account Dashboard
- Click "Manage Billing" to access the Stripe Customer Portal
- Select "Cancel Subscription"
Upon cancellation:
- You retain access to paid features until the end of your current billing period
- No refunds are provided for partial billing periods
- Your account reverts to the Free Plan after the billing period ends
4.5 Refund Policy
We offer refunds in the following circumstances:
- Billing errors or duplicate charges (full refund)
- Technical issues preventing Service use (prorated refund at our discretion)
- Cancellation within the first 14 days of initial paid subscription (full refund)
Refund requests must be submitted through the contact form within 30 days of the charge.
4.6 Price Changes
We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing period and will apply from your next renewal date. You may cancel before the price change takes effect.
5. Data Responsibility and Privacy
Critical Notice: You Are Responsible for Patient Data Security
IrisMapper Pro stores patient health information (names, images, clinical notes) locally in your browser's IndexedDB using client-side encryption. This data never leaves your device unless you explicitly export it.
5.1 Your Responsibilities
By using IrisMapper Pro, you agree to:
- Comply with all applicable data protection laws (GDPR, HIPAA, local regulations)
- Obtain proper consent from patients before storing their data
- Secure your device and browser with password protection
- Regularly back up important patient data by exporting it externally
- Understand that clearing browser data will permanently delete patient records
5.2 Data Loss Disclaimer
We are not responsible for data loss resulting from:
- Browser cache clearing or site data deletion
- Browser uninstallation or operating system reinstallation
- Device loss, theft, or failure
- Use of privacy/incognito browsing modes
- Switching devices or browsers
Patient data is stored locally in your browser and is your responsibility to back up and secure.
5.3 HIPAA Compliance Notice
IrisMapper Pro is NOT HIPAA Compliant
Patient Health Information (PHI) is stored in browser IndexedDB, which is not a HIPAA-compliant storage environment. If you are subject to HIPAA regulations, you must:
- Use pseudonyms or initials instead of full patient names
- Avoid entering sensitive identifiers (SSN, full DOB, medical record numbers)
- Obtain informed consent from patients acknowledging the storage method
- Review our Compliance page for detailed recommendations
5.4 Privacy Policy
Our data collection, use, and protection practices are described in our Privacy Policy. By using the Service, you also agree to the Privacy Policy.
6. Acceptable Use
6.1 Permitted Use
You may use IrisMapper Pro for:
- Professional iris analysis and documentation
- Patient consultations and record-keeping
- Educational purposes related to iridology
- Clinical research (subject to appropriate ethics approval)
6.2 Prohibited Use
You may NOT use IrisMapper Pro to:
- Violate any laws or regulations
- Infringe intellectual property rights
- Upload malicious code, viruses, or harmful content
- Attempt to reverse engineer, decompile, or hack the Service
- Resell, redistribute, or sublicense the Service
- Use the Service for automated or bulk processing without authorization
- Share account credentials with unauthorized users
- Make medical diagnoses or treatment decisions solely based on iris maps without proper clinical training
7. Intellectual Property
7.1 Our Rights
IrisMapper Pro, including its code, design, logos, and documentation, is protected by copyright, trademark, and other intellectual property laws. We retain all rights, title, and interest in the Service.
7.2 Iris Mapping Systems
The iris mapping systems (Angerer, Bourdiol, IrisLAB, Jaussas, Jensen, Roux) are licensed for use within IrisMapper Pro. You may not extract, reproduce, or distribute these maps outside the Service.
7.3 Your Content
You retain all rights to patient data and images you upload to IrisMapper Pro. We do not claim ownership of your content. However, you grant us a limited license to process your content solely for providing the Service (e.g., rendering maps on your images).
8. Disclaimer of Warranties
IrisMapper Pro is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Accuracy or reliability of results
- Security of data stored in browser IndexedDB
Medical Disclaimer: IrisMapper Pro is a documentation and visualization tool only. It does not provide medical advice, diagnoses, or treatment recommendations. Iris analysis should be performed by qualified healthcare practitioners as part of a comprehensive clinical assessment. We are not responsible for clinical decisions made using this software.
9. Limitation of Liability
To the maximum extent permitted by law, IrisLab and its affiliates shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of data, profits, revenue, or business opportunities
- Service interruptions or unavailability
- Third-party actions (including payment processor issues)
- Misuse of the Service or patient data breaches
Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless IrisLab from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use or misuse of the Service
- Your violation of any laws or third-party rights
- Patient data breaches or HIPAA violations
- Clinical decisions or patient harm resulting from use of the Service
11. Service Modifications and Termination
11.1 Service Changes
We reserve the right to:
- Modify, suspend, or discontinue any part of the Service at any time
- Update features, iris mapping systems, or interface elements
- Implement maintenance downtime with reasonable notice
11.2 Termination by Us
We may terminate or suspend your account immediately if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay subscription fees
- Compromise Service security or stability
11.3 Effect of Termination
Upon termination:
- Your access to paid features ends immediately
- Account data stored in Firebase may be deleted after 90 days
- Patient data in your browser remains until you clear it manually
- You must cease using IrisMapper Pro branding and materials
12. Governing Law and Disputes
12.1 Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
12.2 Dispute Resolution
Before initiating legal action, you agree to contact us via the contact form to attempt informal resolution. If informal resolution fails, disputes shall be resolved through binding arbitration or courts in England and Wales.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and IrisLab regarding the Service.
13.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full effect.
13.3 Waiver
Failure to enforce any provision does not waive our right to enforce it later.
13.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations at any time.
13.5 Updates to Terms
We may update these Terms periodically. Changes will be posted on this page with an updated "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email.
